What legal options are available if a debtor refuses to pay? ¶
If informal recovery efforts fail, legal action may be necessary. Options include:
- Issuing a County Court Claim for unpaid debts and then seeking a County Court Judgment (CCJ)
- Enforcing a CCJ through bailiffs or High Court Enforcement Officers, charging orders, or third-party debt orders
- Issuing a Statutory Demand, which could lead to insolvency proceedings.
- In some industries, other processes such as adjudication or arbiration are common.
Can I charge interest on overdue invoices? ¶
Yes. The amount of interest depends on the type of contract and your terms and conditions (if any). In certain circumstances, under the Late Payment of Commercial Debts (Interest) Act 1998, businesses can claim interest (currently 8% above the Bank of England base rate) on overdue invoices, plus compensation. Alternatively you may be able to claim contractual interest or interest under the County Court Act or Senior Courts Act.
How long do I have to pursue a debt before it becomes unenforceable? ¶
In the UK, generally, a debt may become "statute-barred" after six years under the Limitation Act 1980. However, the law on the area is complicated and the limitation period could be longer or it could be extended. If you are owed money, and are concerned about limitation, please contact us urgently.
